PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS IN RELATION TO YOUR USE OF WWW.VANESSAJAYNEDESIGN.COM AND ALL CONTENT AND SERVICES INCLUDED HEREIN. UPON YOU PLACING AN ORDER OR ENGAGING OUR SERVICES, THESE TERMS AND CONDITIONS REPRESENT A LEGALLY ENFORCEABLE AGREEMENT.

Scope

1. These terms and conditions will apply to use of www.vanessajaynedesign.com (hereafter referred to as the website or our website) by you (hereafter referred to as you, your or the consumer) and Vanessa Jayne Design (hereafter referred to as the company, us, our, or we).

2. These terms and conditions will apply to the purchase of any goods or services by you from us.

3. These are the terms and conditions under which we sell all goods and services to you. By ordering any goods or services from us, you agree to be bound by these terms and conditions.

 

Use of our website

4. Unless otherwise specified, all website content is the intellectual property of Vanessa Jayne Design including text, images and other creative media featured on our website. We have the sole copyright to such materials including the rights to reproduce, sell, distribute or publicly display any images or creative media.

5. Our intellectual property must not be copied, modified or altered under any circumstances.

Goods

6. We define goods as goods or products we provide to you including the number and description as set out in your order

7. The description of any goods is as set out on our website or any other form of advertisement. Any description is, however, for illustrative purposes and there may be small discrepancies in the colour or size of goods.

8. We provide seasonal floristry products and reserve the right to change items in orders (e.g., flowers, foliage, stems or other materials) to use what is seasonally available in the UK and in line with the company’s ethos. All orders are therefore subject to change on this basis.

9. In the case of goods provided to a custom brief or specification, it is your responsibility to ensure that all information you provide is accurate.

Services

10. We define services as any services provided to you as per the information agreed in any formal quote, contract, communication or correspondence between you and us.

11. The description of any services is as set out on our website or any other form of advertisement. Any description of services is for illustrative purposes only.

12. In the case of services provided to you, it is your responsibility to ensure that all information you provide is accurate.

Delivery

13. We may agree to deliver goods or services to you. Where this is the case, the precise details and terms of delivery will be communicated to you clearly including any delivery charges you may need to pay. These charges shall be payable prior to delivery of the final product or service.

14. The delivery location refers to the consumer’s location or any other location to which goods or services are to be supplied.

15. It is your responsibility to ensure that information regarding the location for delivery and the preferred times or dates for delivery are communicated to us clearly. We reserve the right to vary the date or time of delivery should this be required, or in the event of force majeure.

BASIS OF SALE

16. The description of goods and services on our website or in any other advertising medium constitutes an invitation to treat and does not constitute a contractual offer of sale.

17. We reserve the right to reject any order for any reason, after it has been made.

18. Any quotation we provide to you is valid for a maximum period of 14 days unless we expressly withdraw it earlier than that time.

19. Quotations and any associated media including images, mood boards, designs, and descriptions of goods and services are the intellectual property of Vanessa Jayne Design and must not be altered or shared without prior permission. This includes sharing images, quotations and design/product/ service descriptions with other florists, floral designers, creators or competitors who may wish to use our designs, images or descriptions to produce work for you. Failure to adhere to this term constitutes breach of our terms and conditions and may leave you liable to damages or legal action.

20. You may be subject to additional contractual obligations in relation to our bespoke services including wedding and event floristry.

WEDDING AND EVENT TERMS AND CONDITIONS

21. Goods and services offered for weddings and events shall be offered in accordance with the above terms and conditions, in addition to the details set out in your quote and any contract you have entered into with us.

22. Your order for weddings and events is not secured nor your booking confirmed until we receive payment of your deposit.

23. Payment of your deposit constitutes agreement to these terms and conditions and any contract set out by us.

24. All deposits are non-refundable.

25. An additional deposit may be required if you are hiring items from us for your wedding/event (e.g., glassware, tableware, hardware installations, etc). Details of any additional deposits shall be included in your quote and/or final invoice. Unless otherwise stated, additional deposits are fully refundable less the cost of any losses or damages incurred on or at your wedding/event (this includes, but is not limited to, losses or damages caused by yourselves, members of your party, guests, venue staff and suppliers, whether accidental or deliberate).

26. We shall not be liable for failure of or delay in performing obligations set forth in this agreement, and shall not be deemed in breach of obligations, if such a failure or delay is due to natural disasters or any causes beyond our control (i.e., Force Majeure).

27. We work with the seasons, therefore it may be necessary on occasion to change some aspects of the goods and services included in your original quote/ design. We will endeavour to discuss any such changes with you in advance and ensure that any substitutions are in line with the original brief. By paying your deposit you agree to us working using seasonally available stock and accept that stock, particularly flowers and foliage, may be subject to change.

28. In the event that we are unable to fulfil your order due to unforeseen, personal or other circumstances, we reserve the right to arrange for an associate or a suitable third party with a similar ethos and style, to fulfil your order. This service will be provided at no extra cost to you. In the unlikely event that we are unable to fulfil your order and cannot arrange an alternative provider of services, we will issue a refund of your deposit/ fee less any reasonable costs we have already incurred.

29. We will work to the budget agreed in your final quote. However, please be advised that any substantial design alterations after confirmation of booking will incur an additional administrative fee. If you are adding items to your order due to a design change, you will also be liable for paying the cost of any additional stock, delivery fees or additional time required to fulfil your amended order. If you are adding additional delivery stops or amending the original delivery address, you may incur additional delivery fees. Your final quote and/or invoice(s) will be adjusted to reflect any such changes.

30. Full payment of the remaining balance (less the initial deposit) is required not less than 4 weeks prior to the date of your wedding or event. We reserve the right to cancel your booking if the final balance is not received in accordance with this timeframe.

31. The final balance is non-refundable within 4 weeks of your wedding and any refunds made outside of this timeframe shall be entirely at our discretion and less the cost of our time and any stock that we have already bought for your order.

What information do we collect?

32. When you interact with us, we may collect your name, address, email address(es) and telephone number(s).

How do we collect information?

33. We may collect information about you whenever you interact with us. For example, when you contact regarding our activities, goods, services, mailing list, or send or receive information, you specifically and knowingly provide us with your personal information. We may also receive information about you from third parties – but only if you have given them permission to share your information.

Confidentiality

34. We will not be responsible for the privacy of data collected by websites not owned or managed by Vanessa Jayne Design, including those linked through our website.

MAKING A COMPLAINT

If you are not satisfied with the response, please contact us at vanessa@vanessajaynedesign.com with the details explaining your concerns. We will review your complaint and investigate if the right procedures have been followed and respond back to you as appropriate. We aim to complete this investigation within 14 working days of receiving your complaint, however, in some cases it may take longer. If you are still unsatisfied with the response, you may contact us.
